Terms of service

The service

Seratify lets organisations, such as cultural centres, companies, and universities, create forms, publish them, and collect responses. We may add, change, or remove features over time. We will tell you in advance about changes that take away something important.

Seratify is currently free of charge. If we introduce prices, we will announce them at least 30 days in advance, and nothing will cost money without your agreement.

Your account

• You must be at least 16 and give a real name and an email address you control.
• Keep your password secret. You are responsible for what happens in your account.
• If you create an account for an organisation, you confirm that you may act on its behalf.

Your responsibilities toward respondents

For the answers you collect, you, or the organisation you act for, are the controller under the GDPR. That means you:

• have a lawful reason to collect each answer you ask for;
• tell respondents who you are and what you will do with their answers, for example with a consent question that links to your own privacy policy;
• collect sensitive information, such as health, religion, or political views, only when the law allows it and you truly need it;
• delete answers you no longer need.

Our data processing agreement describes how we handle the answers for you. It is part of these terms.

What is not allowed

• Phishing, or asking for passwords, bank details, or identity documents under false pretences.
• Spam, scams, or pretending to be someone else.
• Content that is illegal, discriminatory, threatening, or that harms children.
• Collecting data from people without their knowledge, or selling collected data.
• Attacking, overloading, or probing Seratify, or getting around its limits.

Your content

Your forms, images, and collected answers remain yours. You give us permission to store, process, and show them only as needed to run Seratify for you. You confirm that you have the right to use what you upload.

Suspension and closing forms

If you break these terms, or the law, we may close a form, suspend your account, or end it. Where we can, we warn you first and explain why. If a form puts people at risk, for example through phishing, we act immediately. You can object by writing to info@seratmedia.com.

Ending your account

You can delete your account at any time in your account settings. Download your responses first: deleting your account deletes your workspace, your forms, and their responses. Data disappears from backups within 30 days.

Availability and liability

We work hard to keep Seratify available and your data safe, and we make daily backups. We cannot promise that the service will never be interrupted or free of errors.

As far as the law allows, we are not liable for indirect damage, such as lost profit or missed opportunities. Our total liability is limited to the amount you paid us in the twelve months before the damage, or 100 euros if you paid nothing. These limits do not apply to damage caused intentionally or through gross negligence.

Changes to these terms

When we change these terms in a way that matters, we ask you to accept the new version when you next sign in. If you do not agree, you can delete your account.

Applicable law

Dutch law applies. Disputes go to the competent court in the Netherlands, unless the law gives you, as a consumer, the right to go to a court where you live.
